Tree Preservation Order - Rainow

Tree Preservation Order TPO 100/2024 - Land between Lima Barn & Lima Farm, Blaze Hill, Rainow, Macclesfield, SK10 5BZ, Grid Reference: SJ95018 77750

The order was made on 9 December 2024 and confirmed on 8 April 2025

In simple terms, no one is allowed to cut down, top or lop without our permission any of the trees described in the Schedule of the order and shown on the map.

We have made the order because...

it is expedient in the interests of amenity to protect the tree and it makes a significant contribution to the character of the landscape. The large canopy of the tree is clearly publicly visible from the nearest road and prominent from the footpath to the west. It is located on a farmstead on open hillside and can be seen from a long distance away at various angles from the south and west. The reasons for the decision are as set out in the Notice of Making of the tree preservation order dated 9 December 2024.

We have considered whether or not the order should be confirmed (or, in other words,  made permanent). No objections or other comments were made about the order. On 8 April 2025 the Authority decided to confirm the order.

The validity of a TPO cannot be challenged in any legal proceedings except by way of application to the High Court under sections 284 and 288 of the Town and Country Planning Act 1990 ("the Act").  An application to the High  Court may be made by any person who is 'aggrieved'  by a TPO on the grounds:

  1. that the TPO is not within the powers of the Act, or
  2. that the requirements of the Act or Regulations have not been complied with in relation to the TPO

To be 'aggrieved' applicants should be able to show that they have a sufficiently direct interest in the matter.

An application may not be made without the leave of the High Court.  An application for leave must be made before the end of the period of six weeks beginning on the day after the date on which the order is confirmed.

In relation to a tree preservation order, the High Court may quash or suspend the operation of the order either in whole or in part, as the court may determine.
